Terms of Service

1. Acceptance of Terms

By downloading, installing, or operating the DesktopBrain software application (“Software”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use the Software.

2. Software License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Software on devices owned or controlled by you, subject to these terms.

You may not:

• Modify, reverse-engineer, decompile, or disassemble the binary distribution of the Software.
• Rent, lease, lend, sell, or sublicense the Software to other parties.
• Circumvent or attempt to bypass licensing restrictions or trial mechanisms.

3. User Responsibilities & Data Safety

Because DesktopBrain runs locally and does not upload your files, you are solely responsible for keeping backups of your files and managing folder permissions. While DesktopBrain provides local ledger undo options, we advise regular system backups (e.g. Apple Time Machine) to ensure data safety.

DesktopBrain will not be responsible or liable for any deletion, modification, or placement issues of files that arise due to system file corruption, hardware failures, or permission overrides.

4. No Warranty

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DEFECTS.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS OF DESKTOPBRAIN BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA OR FILE ACCESSIBILITY, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.

6. Intellectual Property

All titles, copyrights, trade secrets, trademarks, patents, and other intellectual property rights in and to the Software (including but not limited to any images, graphics, text, icons, AI weights, and source code) are owned by DesktopBrain.

7. Updates and Changes

We reserve the right to modify, suspend, or discontinue the Software or these terms at any time without notice. Continued use of the Software after alterations implies your acceptance of the updated terms.
